1. Agreement and scope
These Website Terms and Conditions (“Terms”) apply to your access to and use of www.eliteprotection.biz, including its pages, forms, consultation scheduling, training and course listings, and online checkout features (collectively, the “Site”). “ESG,” “Elite Security Group,” “we,” “us,” and “our” refer to Elite Security Group, Inc.
By using the Site after these Terms are made available to you, you agree to them to the extent permitted by law. For a purchase, account, or other transaction that requires separate consent, ESG will present the applicable terms and request your affirmative acceptance. If you do not agree to these Terms, do not use the Site.
These Terms govern the Site only. They do not create a contract for security services, employment, training enrollment, or any other paid service unless ESG and you enter into a separate agreement or complete an applicable transaction under terms presented for that transaction.
2. Eligibility and your account
You may use the Site only in compliance with these Terms and applicable law. If you use the Site for a company or other organization, you represent that you have authority to act for it. You are responsible for the accuracy of information you submit and for maintaining the confidentiality of any account credentials issued to you. Notify ESG promptly if you believe your account or credentials have been used without authorization.
3. Website information and emergencies
The Site provides general information about ESG, security services, consultations, training, and employment opportunities. Website content is informational and may not reflect the terms, conditions, or legal requirements that apply to a particular location, client, event, course, or security assignment. Contact ESG for a proposal or written confirmation of current offerings.
Do not use the Site, its forms, or email to report an emergency, request immediate protection, or report an active threat. The Site is not an emergency response service and messages may not be monitored continuously. For an emergency, contact 911 or the appropriate local emergency authority.
4. Security services and separate agreements
A request for information or a consultation is not an offer, acceptance, or guarantee that ESG will provide security services. A consultation booking is a request for a meeting and does not itself create a client relationship, establish a duty to protect a person or property, or authorize ESG to begin work.
Any security services ESG agrees to provide will be governed by a separate written service agreement, statement of work, or other contract signed or accepted by the parties. That agreement will control service scope, locations, staffing, response expectations, access to client systems or premises, fees, insurance, reporting, data handling, and other operational terms. If a separate agreement conflicts with these Site Terms, the separate agreement controls for the services it covers.
5. Training courses and online purchases
The Site may display training courses and allow you to submit an enrollment request or place a course order. Course descriptions, dates, locations, prices, availability, prerequisites, eligibility, required equipment, and completion or certification criteria may change. The details displayed for a course and the terms presented during checkout or enrollment apply to that transaction.
Submitting an order or enrollment request does not guarantee acceptance, a seat, course availability, certification, licensing, or employment. ESG may correct listing errors, decline an order where permitted by law, or cancel a course when necessary. If ESG cancels or materially changes a paid course, ESG will follow the refund, credit, or rescheduling terms disclosed for that purchase and applicable law.
Before participating, you must review and follow the course-specific safety rules, instructor directions, eligibility requirements, and any separately provided waiver or consent form. Training is educational and does not replace applicable licensing requirements, professional judgment, or advice from a qualified legal or medical professional. A course completion document is not a government license or credential unless the issuing authority expressly recognizes it as such.
6. Careers and employment inquiries
A job posting or careers page is an invitation to submit information for consideration, not an offer of employment. Submitting an application does not guarantee an interview, hiring decision, position, schedule, or compensation. Any employment relationship is subject to a separate written offer and applicable employment documents. Applicant information is handled under the ESG Privacy Policy and applicable law.
7. Acceptable use
You may not use the Site to violate law or another person’s rights; submit false, misleading, threatening, or unlawful content; interfere with Site operation or security; attempt unauthorized access to any account, server, network, or system; upload malware or harmful code; scrape or harvest information using automated means without ESG’s written permission; impersonate another person; or use ESG’s name, marks, or content to suggest an endorsement or affiliation that ESG has not authorized.
Do not submit passwords, payment-card security codes, Social Security numbers, detailed site security plans, confidential client materials, or other sensitive information through a general inquiry form. Use a secure channel specifically designated by ESG if such information is requested.
8. Intellectual property and submitted information
The Site and its text, graphics, photographs, videos, logos, service marks, page design, and other content are owned by ESG or its licensors and are protected by intellectual property laws. ESG grants you a limited, revocable, nonexclusive permission to access and display Site content for your personal or internal business evaluation. You may not reproduce, modify, distribute, publicly display, sell, or create derivative works from Site content without ESG’s prior written permission, except as permitted by law.
You retain rights you already hold in information you submit. You give ESG permission to receive, store, review, and use that information as reasonably necessary to respond to you, evaluate a service or job inquiry, process an order, operate the Site, and meet legal obligations, consistent with the Privacy Policy and any separate agreement. Do not submit information you lack authority to provide.
9. Privacy
ESG’s collection and use of personal information through the Site are described in the Privacy Policy at [https://elitestrategicsecurity.com/privacy-policy]. The Privacy Policy is incorporated here only for matters concerning privacy and personal information. Where a privacy law requires a separate notice or consent, that notice or consent will apply.
10. Third-party services and links
The Site may link to or use third-party websites, scheduling tools, payment services, social media, maps, or other services. Those services are controlled by their own operators and are subject to their own terms and privacy notices. ESG does not control or warrant third-party services. Your use of them is at your own discretion and may be subject to additional terms between you and the provider.
11. Availability and disclaimers
The Site is provided on an “as available” basis. To the fullest extent permitted by law, ESG disclaims warranties that the Site will be uninterrupted, error-free, secure, current, or suitable for a particular purpose. ESG does not warrant that every description, schedule, price, availability statement, or other Site content is complete or current. ESG may change, suspend, or discontinue any Site feature or content.
Nothing in these Terms excludes a warranty, remedy, or right that applicable law does not allow ESG to exclude or limit. The Site is not a substitute for emergency services, an individualized security assessment, legal advice, or a written agreement describing the services ESG has accepted.
12. Limitation of liability
To the fullest extent permitted by applicable law, ESG and its officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of or inability to use the Site, third-party services, or Site content, even if ESG was advised that such damages were possible.
This section does not limit liability that cannot lawfully be limited, including any liability that applicable law prohibits ESG from disclaiming or limiting. It does not modify a separate signed agreement or the rights and remedies available for a paid course transaction under that transaction’s terms and applicable law.
13. Indemnification
To the extent permitted by law, you agree to reimburse ESG for third-party claims, losses, and reasonable costs, including attorneys’ fees, to the extent caused by your unlawful use of the Site, your material breach of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from ESG’s own acts or omissions, and it does not waive rights that cannot be waived under applicable law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where mandatory law requires otherwise. Any court proceeding concerning these Terms must be brought in a state or federal court with jurisdiction in Nevada, subject to applicable consumer-protection laws and rules governing personal jurisdiction. Nothing in this section prevents either party from seeking relief in another forum when required by law.
Before filing a non-emergency claim, you and ESG are encouraged to contact one another and try to resolve the issue informally. This does not shorten any legal deadline or prevent either party from seeking urgent court relief.
15. Changes, severability, and entire agreement
ESG may update these Terms by posting a revised version on the Site and changing the effective date. Changes apply prospectively from the stated effective date unless applicable law requires affirmative consent. Material changes to an existing paid transaction will be handled under the terms applicable to that transaction and applicable law.
If a court finds a provision unenforceable, the remaining provisions will remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms and the policies or transaction terms expressly incorporated into them govern your use of the Site and replace earlier website terms on the same subject. They do not replace a separate written agreement.
